Terms & Conditions

Peak Life is operated by Evans Performance - FZCO, a company registered in Dubai, United Arab Emirates ("we", "us" or "our") at peaklifeofficial.com (the "Site"). These terms apply to everything we offer through the Site, including our training programs, video lessons, guides, calculators, worksheets and downloads (together, the "Programs").

By creating an account, buying a Program or using the Site, you agree to these Terms & Conditions, our Privacy Policy, our Refund Policy and our Disclaimer. If you do not agree, please do not use the Site.

18 and over

You must be 18 or older to create an account or buy a Program. By doing so you confirm that you are 18 or older and legally able to accept these terms.

Your account

You sign in with your email address and a password. Keep your login details private, and tell us straight away if you think someone else has used your account. We may treat anyone who signs in with your details as you.

  • The information you give us must be true and kept up to date.
  • One person may hold only one account. Accounts may not be shared, sold or transferred.
  • Accounts created by bots or other automated means are not allowed.
  • We may refuse or close any account at our discretion.

What you buy

Each Program is digital. When your payment is confirmed, we unlock the Program in your account. We may change how Program content is formatted and presented, and we may update, improve or replace lessons over time.

Where a Program is sold with "lifetime access", it means access for as long as we continue to operate that Program and the Site, not for the lifetime of the buyer. If we ever stop offering a Program you have paid for, we will give you reasonable notice by email.

Your purchase gives you a personal, non-exclusive, non-transferable and revocable licence to use the Program for your own non-commercial use, in line with these terms.

Prices and time-limited offers

Prices are shown in US dollars unless stated otherwise, and each Program is a one-time payment unless the offer says otherwise. Some offers are only available for a limited time, and the Site shows a countdown where that applies. When an offer ends, its price may no longer be available and a higher price may apply. We may change our prices at any time before you place an order.

Payment

Card payments are processed securely by Stripe, and cryptocurrency payments by our own payment server. From time to time another payment company may process your payment instead; the checkout shows which one. Each is subject to that company's own terms. We never see or store your full card number.

When you pay by card, Stripe keeps your card on file so that you can add a later offer in one click. We only charge a saved card when you choose to buy something. You can ask us to remove a saved card at any time.

  • We do not start providing a Program until payment has been received in full and has passed our fraud checks.
  • We may ask for more information to verify an order. If you do not provide it, we may cancel the order and refund any payment received.
  • If a payment cannot be processed, we will let you know. You may need to contact your card issuer or payment provider to resolve it.
  • We may cancel all or part of an order before we accept it.

Refunds

Our Refund Policy explains when and how you can ask for a refund. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the consumer protection laws of the country where you live that cannot lawfully be excluded.

Our content

We own or license all intellectual property in the Site and the Programs, including the text, videos, programs, recipes, worksheets, graphics and software (our "Materials"). Our Materials are the result of extensive research, experience and work, and they are protected by intellectual property laws and international treaties. All rights are reserved.

You may view and download our Materials for your own personal, non-commercial use. You must not copy, record, share, resell, publish or make them available to anyone else, share your login, or use them in any business, without our written permission.

Referral program

Members can share a personal referral link. Referral commissions are tracked and paid through our referral platform, Tolt, under the program terms shown in your account and Tolt's own terms. No commission is paid on a purchase that is refunded or disputed. We may change, suspend or end the referral program at any time.

Rules for using the Site

You must not:

  • interfere with, overload or try to break the security of the Site, or transmit any virus or harmful code;
  • scrape, copy, index or harvest the Site or the Programs by any automated means;
  • reverse engineer, decompile, frame or reformat any part of the Site;
  • use the Site for anything unlawful, fraudulent, misleading or harmful, or to send spam;
  • pretend to be someone else or misrepresent your connection with anyone;
  • post or send anything abusive, harassing, threatening, defamatory, obscene or discriminatory to us or to other members; or
  • use our Materials in a business that competes with Peak Life.

Suspension and termination

We may suspend or end your access on 7 days' written notice. We may suspend or end it immediately if you breach these terms, if we reasonably suspect you are copying or misusing our Materials, if we cannot verify information you have given us, or if you behave towards us or other members in a way we consider bullying, harassing or intimidating. If we end your access without cause, we will refund you as set out in our Refund Policy. Every disclaimer and limit of liability survives termination.

Health and fitness

Our Programs are general fitness, nutrition and wellbeing information. They are not medical advice. Please read our Disclaimer before you start, and get clearance from a qualified medical practitioner first.

Disclaimer of warranties

To the maximum extent permitted by law, the Site and the Programs are provided "as is". We make no promise that the Site will be uninterrupted, secure, error-free or free of viruses, that it will meet your expectations, or that any information on it is complete or up to date. We may restrict access to some or all of the Site or the Programs from time to time for business or operational reasons.

Limitation of liability

To the maximum extent permitted by law, we exclude all liability for any loss or damage of any kind, including indirect or consequential loss, loss of data and loss of profit, arising from or in connection with the Site, the Programs or these terms.

Some consumer laws give you rights that cannot be excluded. Where they apply, and as far as they allow, our liability for breaching one is limited, at our option, to supplying the services again or paying the cost of having them supplied again, except where the law entitles you to another remedy for a major fault. Our total liability arising from or in connection with the Site is limited to the greater of the amount you paid us in the twelve months before the claim and US$100.

Indemnity

You indemnify us against claims, losses and costs arising from your breach of these terms or your unlawful use of the Site, except to the extent we caused them.

Changes to these terms

We may update these terms to reflect changes to our Programs or the law. If we make a material change, we will give you reasonable notice by email or on the Site. The updated terms apply from the date of that notice, and the current version is always on this page.

General

  • These terms are governed by the laws of the Emirate of Dubai and the applicable federal laws of the United Arab Emirates, and you and we submit to the non-exclusive jurisdiction of the courts of Dubai. If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live.
  • If any part of these terms is found to be unenforceable, the rest continues to apply.
  • If we do not act on a breach straight away, we can still act on it later.
  • You may not transfer your rights under these terms. We may transfer ours, for example if the business is sold.
  • We are not liable for delays caused by events beyond our reasonable control.
